LAND LEASE DETAILS

This summary is to provide a brief overview of the option to purchase the fee interest in 214 lot residential community known as Monarch Bay, which option is owned by the Monarch Bay Land Association (“MBLA”). 60% of Monarch Bay Residents currently have a sub-leasehold interest in their respective lots with another 40% of homes that are owned fee simple. For a complete understanding of the option, you should read the option agreement dated 9/2/88 in its entirety. MBLA is a nonprofit corporation owned by the residents of Monarch Bay. Each member interest is attached to each of the 214 residential units in Monarch Bay and not separately transferable. MBLA is a single purpose entity formed to acquire, hold and execute an option to purchase the entire fee interest in Monarch Bay on July, 1 2020 pursuant to the Option Agreement.

If the respective appraisers’ valuations are within 10%, the difference will be split and that average will be the agreed upon value (otherwise a third appraiser will be retained and the three appraisals averaged). MBLA will then purchase the 214 lots at 65% of that agreed upon value and in turn offer then existing home owners the right to buy their lot 65% of its appraised value, plus the allocated portion of any costs and expenses associated with MBLA’s exercise of the option and acquisition of Monarch Bay.

Once again, for complete accuracy you should read the option agreement in its entirety. If you or a prospective buyer have any questions, consult with your own legal and tax counsel.

Commencing in the year 2019, if MBLA and the current owner of the fee interest in the Monarch Bay (which are various family trusts) do not agree on an aggregate value for the fee interest in Monarch Bay, each will retain an appraiser. The Option Agreement provides that separate appraisals will be done on each of the 214 lots using the market data approach on a “finished lot” basis. What this means is that the appraiser will not take into account the value of single family dwellings, Monarch Bay Club improvements, attached and detached garages, swimming pools, spas, hot tubs, landscaping, tennis courts, fences, walls, guard houses and gates, but will be entitled to value certain infrastructure such as streets, utilities, sidewalks and other such improvements installed and all governmental approvals that would enable single family residences to be built and occupied on each lot.

The total value for Monarch Bay will be the sum of these 214 separate appraisals. Existing Monarch Bay amenities such as the tennis court area and Beach Club and parking lot will become common area owned pro rata by all homeowners and all of Monarch Bay shall be subject to CC&Rs administered by the Homeowners’ Association.

Q1. What amenities are included as a Monarch Bay Home Owner?
A1. 24 Hour guard gated community, Monarch Bay Club access, 25% food & non alcoholic beverages at The Bay Club, dedicated host service at the beach, access to the neighborhood tennis court, access to the neighborhood playground area, private beach front parking at salt creek beach.

Q2. Can I lease my property as a short term rental in Monarch Bay?
A2. Currently there is a minimum 1 month lease term for all homes in Monarch Bay.

Q3. Can tenants use neighborhood amenities such as the Bay Club?
A3. A minimum 6 month lease is required to transfer neighborhood amenities to a lease tenant.

Q4. Are there any other discounts on Monarch Beach Resort Memberships offered to current and New Monarch Bay home owners?
A4. Contact the Monarch Bay Membership team for details and incentives to add a Resort or Wellness membership as an enhancement to your current Resident benefits.

Q5. Can guests use Monarch Bay’s neighborhood Amenities?
A5. Guests are permitted to use neighborhood amenities when they are accompanied by a Monarch Bay home owner.

Q6. What financing is available for Monarch Bay Homeowners?
A6. There is a current land lease agreement that expires in the year 2020 when home owners must purchase their land from the lease holder. Monarch Bay currently has approximately 40% fee simple homes (home owners who own their lots) & 60% lease hold (home owners who lease their lots). There are several lenders we can recommend for both forms of purchasing.

Q1. Can I purchase my land prior to the 2020 land lease expiration date?
A1. There is currently no opportunity to purchase your land before 2020.

Q2. How do I go about changing my guest information with the guardhouse?
A2. Monarch Bay utilizes a software system called dwellingLIVE. You can go online at www.dwellingLIVE.com to change your guest lists and add permanent and temporary guests.

Q3. I purchased a new vehicle and need a new decal, how do I obtain one?
A3. Please call Progressive Community Management at (949) 582-7770 to be provided with the decal.

Q4. Who is PF Consultants and why do I mail them my ground rent payment?
A4. PF Consultants is an entity owned by CalWestern Finance and they collect the ground rent payments from each lease and then disburse the proportionate amount to MMB, LLC and to Cal Western each quarter. Those owners that purchased their land in 2016 no longer are subject to ground rent payments.

Q5. My neighbor’s tree is blocking my ocean view but I don’t want to approach them. Will the Association help with this?
A5. Please see the Association’s Tree/View Policy for assistance. We ask that you make the initial contact with your neighbor pursuant to step 1 of the policy. This typically resolves the issue amicably; however, if further assistance is needed, please proceed with the following steps identified in the policy.
